The Maine State legislature has recently increased the maximum penalty for Wrongful Death from $150,000.00 to $400,000.00.

 

What is a wrongful death?

Wrongful death statutes were created to protect the rights of beneficiaries in the event of the death of a loved one, which was caused by another person.

What types of acts allow for wrongful death suits?

Claims of wrongful death can occur from your negligent acts including auto, ATV, snowmobile and boating accidents. All can and are covered by the appropriate insurance policy.

Who can bring action?

The surviving spouse and/or children and/or other heirs may bring action for a wrongful death.

What is included as damages in a Wrongful Death claim?

You could be responsible for the following;

1. Pain & suffering

2. Funeral expenses

3. Punitive damages

4. Decedents medical and funeral expenses

5. Loss of financial support, comfort, care & affection

How can I protect myself?

We recommend that you carry, at minimum, a combined single liability limit of $500,000 liability on all your insurance policies. Also, it may be time to consider purchasing a $1,000,000.00 umbrella policy to protect yourself and your assets.

What is an Umbrella Policy?

Similar to your rainstorm umbrella, an Umbrella Policy is a canopy of protection fitting over and above your various personal liabilities (homeowners, auto, ATV, snowmobile, boat, etc).
